1.Purpose and application
- These rules apply to everyone who enters the studio: clients, their crews, their guests and their suppliers. The person who made the booking is responsible for their party observing them.
- The rules exist to protect three things: the people in the studio, the equipment your production depends on, and the bookings that follow yours.
2.Arrival, access and time
- Your booked time includes set-up and pack-down. Arrive at your booked start time, not before, unless arranged in advance.
- Access is by arrangement with the studio host. Do not admit people who are not part of your booking.
- Running over the booked end time is billed in confirm overtime increments and rate, for example half-hour increments at the published hourly rate, and only where the schedule behind you allows it.
3.Equipment and rooms
- Studio equipment is operated by, or under the direction of, the studio host. Ask before repatching, moving or reconfiguring anything.
- Report any fault or damage immediately. Honest breakage reported at once is dealt with fairly. Concealed damage is billed at replacement cost.
- You are liable for damage to equipment and rooms caused by your party beyond fair wear and tear, at repair cost, or replacement cost where repair is not economical.
- Food and drink stay in the areas designated for them. No liquids on or above consoles, computers or microphones.
- No smoking or vaping inside. Use the designated outside area.
4.Conduct and safety
- Follow the studio host's safety instructions at all times, including on cabling, rigging and electrical loads.
- No conduct that endangers or harasses anyone. The studio host may stop a session and require a person to leave for serious misconduct, without refund of the time lost.
- Children under 16 must be supervised by an adult in your party at all times.
- Nothing unlawful may be recorded, stored or streamed from the studio.
5.Recordings and content
- Ownership of recorded content is dealt with in the studio terms and your hire agreement. These rules do not change that.
- You are responsible for the rights in what you record: your scripts, your music licences, your guests' consents and releases.
- We may photograph the studio in use for our own marketing only with your prior agreement on the day.
6.Belongings and vehicles
- Your equipment and belongings remain your responsibility. We take reasonable care of the premises but do not insure your property.
- Parking is at the owner's risk. Follow the host's directions on where to park and load.
7.Disputes, governing law and jurisdiction
- These terms are governed by the law of the Republic of South Africa.
- The parties first attempt to resolve any dispute by good-faith negotiation between senior representatives within ten business days of written notice of the dispute.
- If negotiation fails, the parties may agree to mediation in Cape Town or by video conference before either approaches a court or, where agreed in a signed agreement, arbitration.
- The parties consent to the jurisdiction of the Magistrates' Courts with jurisdiction over our registered address, without excluding either party's right to approach the High Court of South Africa, Western Cape Division.
- Nothing in this clause prevents a consumer from using any statutory complaint or redress channel available under South African consumer protection law.
